Terms of Service

1. Application

These Terms of Service (the "Terms") set out the conditions for using MaidLink, an information site about maid cafes, concept cafes and similar venues (the "Service"), and govern the relationship between the operator of the Service (the "Operator") and its users. The Service is operated by Kurayami AI (kurayami.ai), a sole proprietorship based in Mexico.

These Terms are a standard-form contract (teikei-yakkan) under the Japanese Civil Code. By browsing or using the Service you agree to them. The Listing Policy and the Privacy Policy form part of these Terms.

2. Definitions

"Listed venue" means a restaurant or other venue whose information appears on the Service. "User" means anyone who browses or uses the Service, including people connected with a venue. "Submission" means a review, correction report, listing request, inquiry, staff listing application or other information a user sends to the Service.

3. Nature of the Service

The Service lets people search and view information about listed venues, such as location, hours, prices and official social accounts.

The Operator does not run any listed venue and is not its agent or partner. The Service does not handle bookings or payments or broker visits; any transaction, visit or service between a user and a venue is solely between them.

The Operator does not conduct any business regulated under Japan's Act on Control and Improvement of Amusement Business (Fueiho).

4. Listed information

Listed information is based on what venues publish on their official websites and social media, checked and summarized independently by the Operator. We take reasonable care, but we do not guarantee that it is accurate, current or complete. Always check the venue's official information before visiting.

Where a venue has not provided photos, the image shown is generated by AI; it is not a photo of the venue and has not been reviewed by the venue.

We decide which venues to list and may change or remove listings at our discretion. Listing criteria and the correction and removal procedures are set out in the Listing Policy.

5. Accounts

Some features, such as posting reviews or confirming a venue, require signing in with LINE or an email address. Accounts are available only to persons aged 18 or older.

You must keep your information accurate, manage your account at your own responsibility, and not let others use it.

6. Submissions

You warrant that your submissions are true and do not infringe anyone's rights. Reviews must be based on an actual visit.

You keep the copyright in your submissions, but grant the Operator a non-exclusive, royalty-free license to use them (including reproduction, public transmission, translation and summarizing) as needed to provide, display, improve and promote the Service, and agree not to assert moral rights against the Operator.

We may hide or remove submissions that we consider to violate these Terms or the Listing Policy, without prior notice.

7. Staff listings

People who work at a venue may, on their own application, have their stage name, workplace, X and Instagram listed. Applicants warrant that the information is true and their own.

We review applications before listing. Listed staff may ask us to delete their listing at any time.

8. Prohibited conduct

You must not, in using the Service:

• violate laws or public order and morals; • post false information or impersonate others; • harm the reputation, credit, privacy or intellectual property of venues, staff, other users or third parties, or defame them; • solicit or broker prostitution or other sexual services, or use the Service to arrange personal encounters; • post personal contact details (phone numbers, messaging-app IDs, etc.); • collect, copy or republish the Service's information in bulk by automated means without our permission; • place excessive load on our servers or network, or access them without authorization; • do anything else we reasonably consider inappropriate.

9. Intellectual property

Rights in the text, design, software and illustrative images of the Service (excluding submissions) belong to the Operator or the rightful owners.

Venue names, trademarks and logos belong to their owners and are used on the Service only to identify the venue.

10. External sites

The Service links to third-party sites such as venues' official websites, social media and map services. We are not responsible for their content or services.

11. Paid services

If we offer paid services to venues (such as advertising placements), their content, price, payment method and cancellation terms will be set out at the time of application and in our Notation based on the Specified Commercial Transactions Act.

12. Personal information

We handle personal information in accordance with our Privacy Policy.

13. Disclaimer and limitation of liability

We make no warranty that the Service or the listed information fits any particular purpose, is accurate or useful, is continuously available, or is free of defects.

We are not liable for damages arising from your use of the listed information or from visits to or dealings with listed venues, except in cases of our willful misconduct or gross negligence, and except where exemption is not permitted under the Consumer Contract Act or other mandatory law.

Where we are liable under the proviso above (other than for gross negligence), our liability is limited to ordinary, direct and actual damages.

14. Changes, suspension and termination

We may change, suspend or discontinue the Service without prior notice.

15. Changes to these Terms

We may amend these Terms in accordance with Article 548-4 of the Civil Code. We will post the amended Terms and their effective date on the Service.

16. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan.

Disputes will first be addressed through good-faith discussion; failing that, the Tokyo District Court has exclusive jurisdiction in the first instance. This does not limit any statutory jurisdiction rights you have as a consumer or the protection of mandatory laws of your country of residence.
