Terms of Service

1. Application

These Terms of Service (the "Terms") govern the relationship between MaidLink (the "Service"), operated by us (the "Operator"), and its users, and apply to all matters relating to your use of the Service. The Service is operated by Kurayami AI (kurayami.ai), a sole proprietorship based in Mexico.

These Terms constitute a standard-form contract (teikei-yakkan) under the Japanese Civil Code. By using the Service you agree to these Terms.

2. Definitions

"Cast" means a user who publishes a profile as a person providing hospitality at a concept cafe or similar venue. "Fan" means a user who follows and supports cast. "Content" means text, images, video and other information that users post or transmit on the Service.

3. Nature of the Service

The Service is a social platform for cast and fans to connect online. The Operator does not run cafes, hospitality venues or any related business. Service at venues, employment and venue operations are the responsibility of the respective venues and individuals; the Operator is not a party to them.

The Operator does not conduct any business regulated under Japan's Act on Control and Improvement of Amusement Business (Fueiho), and prohibits user conduct that violates that or other laws.

4. Age and eligibility

The Service is available only to persons aged 18 or older. We require consent to age confirmation at registration and will refuse or suspend accounts found to belong to minors. We may refuse use by anyone we reasonably consider unsuitable.

5. Accounts

You must keep your registration information accurate and current, are responsible for your account, must not let third parties use it, and are responsible for losses arising from inadequate management or third-party use of your login credentials.

6. Cast identity verification

Cast who receive money (e.g., tips) must complete identity verification (KYC) through our payment processor (e.g., Stripe). Some features may be restricted until verification is complete.

7. Prohibited conduct

You must not, in using the Service:

• violate laws or public order and morals; • solicit, broker or provide prostitution or similar sexual services, or solicit for such purposes; • transmit or post obscene material, child pornography or content involving child abuse; • solicit the exchange of private contact details outside the Service's public features, or solicit private monetary transactions outside the Service; • stalk, harass, threaten, defame, infringe the privacy of, or impersonate others; • infringe intellectual property or other rights of others; • gain unauthorized access, interfere with operation of the Service, or do anything else we reasonably deem inappropriate.

8. Content

Intellectual property rights in Content belong to the posting user or rightful owner. You grant the Operator a non-exclusive, royalty-free license to use Content (including reproduction, display, distribution and resizing) to the extent necessary to provide, display and promote the Service. We may remove or restrict Content we consider to breach these Terms without prior notice.

9. Support (tips) and payments

Payments such as support (tips) and boosts are processed through our payment processor (Stripe). Support is, in principle, paid directly to the relevant cast; the Operator does not hold or custody funds (we do not operate a funds-transfer business) and receives a platform fee.

Given the nature of digital services, payments are in principle non-refundable, except where required by law or where we specifically determine otherwise. See also our "Notation based on the Specified Commercial Transactions Act".

10. Personal information

We handle your personal information in accordance with our Privacy Policy.

11. Disclaimer and limitation of liability

We make no warranty, express or implied, that the Service fits your particular purpose, has the functionality, accuracy or usefulness you expect, is continuously available, or is free of defects.

We are not liable for damages incurred in connection with the Service, except in cases of our willful misconduct or gross negligence, and except where exemption is not permitted under the Consumer Contract Act or other mandatory law.

Where we are liable, our liability is limited to ordinary, direct and actual damages, capped at the total fees you paid us for the Service in the six months before the damage arose (applied consistently with the Consumer Contract Act).

12. Changes, suspension and termination

We may change, suspend or discontinue the Service without prior notice. Liability for resulting damages is governed by the preceding article.

13. Changes to these Terms

These Terms are a standard-form contract. Pursuant to Article 548-4 of the Civil Code, we may amend them where the change benefits users generally, or is reasonable in light of its necessity and appropriateness and not contrary to the purpose of the contract. Material changes will be announced on the Service with an effective date.

14. Governing law and dispute resolution

The Operator runs the Service from Mexico, and the Service is hosted on international infrastructure. These Terms and your use of the Service are governed by the laws applicable in the country where you use the Service and in the country where the Service is operated and hosted.

Notwithstanding the above, mandatory protections afforded to you by the laws of your country of residence (including consumer-protection laws) continue to apply and are not excluded by these Terms.

In the event of a dispute, the parties will first seek to resolve it through good-faith negotiation; failing that, it will be resolved, to the extent permitted by applicable law, before the courts of your domicile or the Operator's location.
